Our new public procurement expert and the latest changes in law

In June 2017 Dr. Gabriella Nagy-Fribiczer, having an outstanding expertise in public procurements, joined Ecovis Hungary Legal.
 
Our new expert began her career in public procurement at Public Procurement Council where she held various positions in the leadership for more than 13 years and also acquired rich experience as the head of international and educational department. Besides, she often teaches, gives lectures and is also extremely active as an author in public procurements. She is a board member of the Hungarian Official Public Procurement Advisors’ Association. In relation to the arrival of our new specialist we would like to draw your attention to some recent changes in public procurements.
 
From June 1, 2017, the Government Decree 321/2015 (X.30.) on the rules of proof of suitability in public procurement procedures changed. The amendment, in the interest of the unified application of the law, has clarified the rules on the periods to be examined in regard to the references for technical and professional ability. In connection with this very same ability requirement, it has also restricted the possibility to require tenderers to indicate the amount of the remuneration.
 
The amendment on the Government Decree 322/2015 (X.30) on the rules of public works contracts abolished the 90-day limitation period having been available to the contracting authority and the successful tenderer prior to the conclusion of the contract to hold negotiations about the items of the priced budget and to finalize the items to be included. In the future it can be done without a limitation period.
