New Act on attorneys is right around the corner

The Ministry of Justice has put forward the draft of the new act on attorneys to social consultation. The proposal is available at the Government’s website.
 
Clients may be also interested in the recent amendments, so we have picked certain provisions to present without going into excessive details.

- According to the proposal, the part of the contingency fee exceeding the 2/3 of the total amount of the attorney’s fee will not be enforceable before court.  

-The minimum of the liability insurance for attorneys will radically grow from HUF 5 million to HUF 15 million per damage event.  
 
- The scope of ancillary services provided by attorneys will also expand: clients may be advised in insurance or HR matters and management of trusts will be also a new activity for attorneys.  

- The proposal contains the long-discussed mandatory completion of vocational education.  

- It is somewhat surprising that the proposal would loosen rules on conflicts of interest: if the Hungarian Parliament adopts the proposal then attorneys may also function as managing directors at companies in the future.
